According to the work plan of the Sheki Court of Appeal for the first half of 2018, on 16 February 2018, the Chairman of the Criminal Board of the Supreme Court of the Republic of Azerbaijan Mr. Shahin Yusifov, judge of the Supreme Court Mr. Ali Rustamov, judge of the Administrative-Economic Board Mr. Rahib Nabizade, and deputy chief of the Organizational-Supervision department of the Ministry of Justice Mr. Afgan Alekberov took part in a meeting on analysis of the work done in 2017 in connection with the administration of justice by the Sheki Court of Appeal, with the participation of the the judges of the Sheki Court of Appeal and the courts of first instance.
Chairman of the Sheki Court of Appeal Mr. Mubariz Akbarov has a speech and briefed the participants on the agenda. He noted that in 2017, the Sheki Court of Appeal had accept to review 4264 cases and material, it’s on 35.97% more than the results of 2016. Having analyzed the statistical data on the results of the appeals process in 2017 in comparison with 2016, the chairman of the court also noted that during the reporting period, in proceeding the review cases on the merits, on 2 criminal cases and 5 civil cases were delivered special decisions regarding the committed violations and for reason to disclosure of the crimes by the relevant articles of the Criminal Code of the Republic of Azerbaijan, the relevant authorities of the prosecutor's office were informed about this violations.
Further, it was emphasized that the Sheki Appellate Court's fully implemented all points of the first and second half-year plans, has been made generalizing of the judiciary practice on 8 issues and sent general letters to the 5 courts of first instance, has been given information by the chairman of the Imishli district court on applying legislation in consideration of civil cases in 2016, and regularly held seminars for the purpose of studying the case law of the European Court of Human Rights. Despite the increase the number of appeals to the court, each appeal was answered within the timeframe established by the law, 11 citizens were accepted by the court administration, 55 persons were accepted by the chairman of the court.
Later, the speakers heard reports of the chairmen of the board of the Sheki Court of Appeal on the work done in the implementation of justice in 2017.
Chairman of the Criminal Board of the Supreme Court of the Republic of Azerbaijan, Mr.Shahin Yusifov, generalizing of the judiciary practice in violations and shortcomings in the application of material and procedural legal norms by the judges of the first and appellate courts in the cassation procedure and brought attention of the participants to the Decree of the President of the Republic of Azerbaijan, Mr. Ilham Aliyev, on February 10, 2017 on "Improvement of penitentiary activities, the importance of the on the extension of the application of alternative penalties and procedural compulsory measures related to the humanization of human rights and its isolation from the society, and the importance of its execution, and the procedural coercion of the accused and stressed the importance of consistently adhering to the recommendations set out in the Decree during the determination of the penalties.
Judge of the Civil Board Mr. Ali Rustamov and judge of the Administrative-Economic Board Mr. Rahib Nabizade took attention of the participants on established position of the Supreme Court on separate cases, bringing the attention of the participants to the violations and shortcomings identified during the consideration of cassation cases in the Supreme Court, and recommended to the judges to properly apply the material and procedural legislation.
Deputy chief of the Organizational-inspection department of the Ministry of Justice of the Republic of Azerbaijan Mr. Afgan Alekberov informed about the complaints received on the activities of the courts, brought statistical figures to the attention of the participants and focused on issues that are of particular concern to the courts.
The event continued with exchange of views on the legal issues of mutual interest with the participation of the judges of the first instance courts, judges of appeal and Supreme Court judges.
The Chairman of the Sheki Court of Appeal, Mr. Mubariz Akbarov, expressed his confidence that the exchange of opinions would be useful and advised to the judges to carry out their activities in order to increase the effectiveness of justice and to make legitimate and fair decisions.
