Registrar of the Supreme Court of the Republic of Azerbaijan Elvin Hatamzade commented on the recent statements published in certain media outlets regarding the lack of exercise of the right of legislative initiative by the Supreme Court of the Republic of Azerbaijan.
E. Hatamzade said that the Supreme Court acts directly in the formation of the legislation of the Republic of Azerbaijan by exercising the right of legislative initiative in accordance with Article 96 of the Constitution of the Republic of Azerbaijan or by expressing legal opinions and offering proposals in the process of drafting legislation.
Hence, the Supreme Court has prepared and submitted relevant drafts to the Milli Majlis in order to improve a number of legislative acts resulting in the legislative body adopting these drafts.
It should also be noted that the Supreme Court has actively participated in the implementation of decrees and orders of the President of the Republic of Azerbaijan by expressing legal opinions and providing suggestions in the preparation of draft legal acts. Hence, over the past two years, the Supreme Court has prepared opinions and proposals on more than 300 draft legal acts addressed to the Supreme Court by government agencies and has submitted them to the relevant government agencies.
In addition, in order to ensure the consistency of the court’s case law in resolving legal issues and the predictability of the legal position on the application of the normative legal acts, the legislation establishes mechanisms for the Supreme Court to fulfil the task of forming a unified judicial practice. In this regard, the decisions of the Supreme Court play an important role in the uniform application of laws and the development of legislation.
