INFORMATION OF THE SUPREME COURT OF THE REPUBLIC OF AZERBAIJAN ON THE ADDITIONAL MEASURES TAKEN IN THE JUDICIARY AIMED AT PREVENTING THE SPREAD OF THE CORONAVIRUS DISEASE (COVID-19) IN THE REPUBLIC OF AZERBAIJAN

    ON THE ADDITIONAL MEASURES TAKEN IN THE JUDICIARY AIMED AT PREVENTING THE SPREAD OF THE CORONAVIRUS DISEASE (COVID-19) IN THE REPUBLIC OF AZERBAIJAN

    Taking into account the Resolution of the Cabinet of Ministers of the Republic of Azerbaijan No. 151 dated 26 May 2021 on the measures to extend the special quarantine regime and to remove some restrictions, the following is recommended to the courts of the Republic of Azerbaijan:

    • From 11 October 2021, to require all persons entering the court premises, as well as those directly involved in the proceedings in closed spaces, to present a COVID-19 passport (COVID-19 vaccination certificate or COVID-19 immunity certificate) or a certificate of medical contraindication to the vaccine against COVID-19 infection;
    • In the absence of a COVID-19 passport or a medical contraindication certificate, to ensure the participation in court hearings of the persons subject to the preventive measures and administrative detention via the videoconferencing system. However, where this is not possible or where their presence at the court hearing in person is required, their direct participation shall be ensured, provided they strictly follow the sanitary-hygienic and medical-prophylactic rules;
    • In cases where defendants (except for persons in respect of whom the issue of preventive measures is being determined), the prisoners sentenced to imprisonment or life imprisonment and other participants of the court proceedings specified in Article 51-2.1 of the Criminal Procedure Code of the Republic of Azerbaijan do not have a COVID-19 passport or a medical contraindication certification and if their health condition makes it impossible for them to participate directly in the court proceedings, and in other cases provided for in Articles 51-2.1.1-51-2.1.4 of this Code, to give a priority to carry out procedural actions, as well as proceedings entirely or partially using the videoconferencing system;
    • To further ensure that judges, court staff and citizens comply with the use of protective masks, follow basic personal hygiene habits, exercise preventive medical care, as well as obey social distancing rules during their stay in the court facilities as well as during the discharge of any procedural requirements indoors;
    • To carry out necessary work for the regular disinfection of the courthouses and equip the office buildings with the protective and hygienic measures.
